Introduction

Workpedia respects the intellectual property rights of others and expects our users and visitors to do the same. This page explains how to submit a copyright infringement claim under the Digital Millennium Copyright Act (DMCA) and how we respond to such claims.

This policy applies to our website at www.workpedia.name.ng. We take copyright infringement seriously and will respond promptly to valid notices of claimed infringement.

What Is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a framework for copyright owners to request the removal of infringing content from websites. It also provides a process for users to challenge those requests if they believe their content was removed in error.

The DMCA creates a "safe harbor" for website operators like us when we:

  • Comply with valid takedown notices
  • Have a policy for handling repeat infringers
  • Designate an agent to receive copyright complaints

This page serves as our designated location for DMCA-related matters and identifies our agent for copyright complaints.

Filing a DMCA Takedown Notice

If you are a copyright owner (or authorized to act on behalf of a copyright owner) and believe that content on Workpedia infringes your copyright, you may submit a DMCA takedown notice.

Before submitting a notice, please consider:

  • Does your use qualify as "fair use"? Fair use allows limited use of copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.
  • Do you actually own the copyright? Ensure you have the legal right to make the claim.
  • Have you identified the correct content? Be specific about what you believe is infringing.
  • Is the content actually hosted on Workpedia? We may link to third-party sites, but we don't control their content.

If you are unsure whether your copyright has been infringed, consult with an attorney before submitting a notice. Submitting a false claim can have legal consequences.

Requirements for a Valid DMCA Notice

Under the DMCA (17 U.S.C. § 512(c)(3)), a valid takedown notice must include the following information:

Requirement Description
1. Signature A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of copyrighted work Identify the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, you may provide a representative list.
3. Identification of infringing material Identify the material that is claimed to be infringing and that is to be removed. Provide information reasonably sufficient to locate the material (such as the specific URL).
4. Contact information Provide your name, address, telephone number, and email address.
5. Good faith statement Include a statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
6. Accuracy statement Include a statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Notices that do not include all of this information may be invalid and cannot be processed.

Submitting Your DMCA Notice

You may submit your DMCA takedown notice through one of the following methods:

Method 1: Email (Preferred)

Email your notice to: workpedia2026@gmail.com

Please include "DMCA Notice" in the subject line for faster processing.

Method 2: Contact Form

Visit our Contact Us page and submit your notice with "DMCA Notice" in the message.

Response Time: We aim to acknowledge receipt of your notice within 2-3 business days and take action within 5-7 business days.

Note: When we receive a valid DMCA notice, we will remove the identified content and notify the user who posted it. We may also forward the notice to the user or other relevant parties.

How We Respond to DMCA Notices

Upon receiving a valid DMCA takedown notice, we will:

  1. Acknowledge receipt – We will confirm that we have received your notice.
  2. Review the notice – We will verify that it meets all DMCA requirements.
  3. Remove or disable access – If the notice is valid, we will promptly remove the allegedly infringing content.
  4. Notify the user – If the content was posted by a user, we will notify them that their content has been removed due to a copyright claim.
  5. Provide counter-notification information – We will inform the user of their right to submit a counter-notification.
  6. Document the notice – We will keep records of all DMCA notices as required by law.

If the notice is incomplete or invalid, we may contact you for additional information or may not take action. We may also forward the notice to the user who posted the content (removing your personal contact information if you request).

Counter-Notification

If you are a user whose content has been removed due to a DMCA notice and you believe the removal was in error (for example, because you have permission to use the material, the material is in the public domain, or your use qualifies as fair use), you may submit a counter-notification.

A counter-notification is a legal request to restore the removed content. It must be submitted in writing and include specific information required by the DMCA.

Before submitting a counter-notification, please consider:

  • Do you actually have the right to use this material?
  • Is your use protected by fair use?
  • Are you prepared for possible legal action from the copyright owner?

If you are unsure, consult with an attorney before submitting a counter-notification. Submitting a false counter-notification can have legal consequences.

Requirements for a Counter-Notification

Under the DMCA (17 U.S.C. § 512(g)(3)), a valid counter-notification must include the following information:

Requirement Description
1. Signature A physical or electronic signature of the user.
2. Identification of removed material Identify the material that was removed and the location where it appeared before removal (the URL).
3. Statement under penalty of perjury Include a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Contact information Provide your name, address, and telephone number.
5. Consent to jurisdiction Include a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, that you consent to jurisdiction in any judicial district where the service provider may be found).
6. Acceptance of service Include a statement that you will accept service of process from the person who filed the original DMCA notice or their agent.

Submitting a Counter-Notification

To submit a counter-notification, please send it to us using one of the following methods:

Method 1: Email

Email your counter-notification to: workpedia2026@gmail.com

Please include "DMCA Counter-Notification" in the subject line.

Method 2: Contact Form

Visit our Contact Us page and submit your counter-notification with "DMCA Counter-Notification" in the message.

What happens next:

  1. We will review your counter-notification for completeness.
  2. If valid, we will forward a copy to the original complaining party.
  3. The original complaining party then has 10-14 business days to file a court action seeking to restrain you from infringing their material.
  4. If they do not file a court action, we may restore the removed content.

This process is required by the DMCA and is not controlled by us. We cannot restore content until this period has passed.

Repeat Infringer Policy

Under the DMCA, service providers must adopt and implement a policy for terminating users who are repeat infringers.

Our Policy:

  • First offense: Content removed, user notified of DMCA policy.
  • Second offense: Warning issued and temporary suspension of posting privileges.
  • Third offense: Permanent ban from interacting with our Site.

We maintain records of DMCA notices and counter-notifications to identify repeat infringers. We reserve the right to terminate access to our Site for any user who repeatedly infringes copyright, regardless of the number of offenses.

Note: Workpedia primarily publishes original content created by our team. We do not currently have user-generated content features (such as comments) enabled. If we add such features in the future, we will update this policy accordingly.

Misrepresentations

Important Warning: The DMCA provides that any person who knowingly materially misrepresents that material is infringing or that material was removed by mistake may be subject to liability for damages (including costs and attorneys' fees).

This means:

  • Do NOT submit a DMCA notice if you are not sure whether you own the copyright or whether the use is infringing.
  • Do NOT submit a counter-notification if you do not have a good faith belief that the material was removed by mistake.

Misrepresentations can result in legal liability. If you are unsure, consult an attorney.

Our Content Usage

Workpedia creates original content about work-from-home terms, job platforms, and workplace concepts. In our educational content, we may reference third-party materials, including:

  • Quotes from experts and publications (with attribution)
  • References to platform names and features
  • Links to external websites and resources

We believe these uses constitute fair use under copyright law, as they are for educational purposes, are transformative, and do not substitute for the original works. However, we respect copyright owners' rights and will respond to valid DMCA notices.

If you believe we have used your copyrighted material in a way that exceeds fair use, please submit a DMCA notice using the information above.
